We are pleased to share the publication of the new book "Rechtsdiskurs, Rechtsprinzipien, Rechtsbegriff: Elemente einer diskursiven Theorie fundamentaler Rechte", edited by Professor Carsten Bäcker (Bayreuth) and published by Mohr Siebeck.
The book brings together contributions presented and discussed at the October 2021 symposium in honour of Robert Alexy's 75th birthday and was attended by world-renowned experts in the field.
Professor Matthias Klatt contributed with the article "Abwägung im Erkenntnisvakuum: Zur Bedeutung und Funktion formeller Prinzipien". Therein, Professor Klatt discusses the difficulties of balancing fundamental rights and other legal principles when opposing empirical or normative premises are equally plausible. He further argues that the key to overcoming the challenges of such cases involves a careful consideration of formal principles from a separation model.
